الكيانات المستبعدة
أ- مع عدم الإخلال بأحكام الفقرة (د) من هذه المادة، لا تسري أحكام هذا القانون على أي كيان مستبعد من الكيانات الآتية:
1- الجهات الحكومية.
2- المنظمات الدولية.
3- المنظمات غير الربحية.
4- صناديق التقاعد.
5- صندوق الاستثمار الذي يكون كيان أم نهائي "Ultimate Parent Entity".
6- أداة استثمار عقاري التي تكون كيان أم نهائي "Ultimate Parent Entity".
7- باستثناء كيان الخدمات التقاعدية، أي كيان مملوك بنسبة لا تقل عن 95% من قيمته من قبل واحد أو أكثر من الكيانات المستبعدة المنصوص عليها في البنود (1) و(2) و(3) و(4) و(5) و(6) من هذه الفقرة، سواء بشكل مباشر أو غير مباشر، وذلك بشرط أن يعمل الكيان بشكل حصري أو شبه حصري على تملك الأصول أو استثمار الأموال لصالح الكيانات المستبعدة، أو أن يمارس بشكل حصري أنشطة مساندة لتلك التي تمارسها الكيانات المستبعدة.
8- باستثناء كيان الخدمات التقاعدية، أي كيان مملوك بنسبة لا تقل عن 85% من قيمته من قبل واحد أو أكثر من الكيانات المستبعدة المنصوص عليها في البنود (1) و(2) و(3) و(4) و(5) و(6) من هذه الفقرة، سواء بشكل مباشر أو غير مباشر، وبشرط أن معظم دخل الكيان ناتج بشكل أساسي من أرباح أو خسائر الأسهم أو حقوق الملكية المستثناة من حساب دخل أو خسارة الكيان المشارك.
ب- مع مراعاة أحكام الفقرة (أ) من هذه المادة، يجوز للكيان المشارك المكلف بالإقرار إجراء الاختيار المطبق لمدة خمس سنوات بعدم معاملة الكيان المشار إليه في البندين (7) و(8) من الفقرة (أ) من هذه المادة على أنه كيان مستبعد.
ج- تسري على الكيانات المستبعدة أحكام المواد (17) و(18) و(19) و(20) و(21) و(22) و(23) و(24) و(25) و(26) و(27) و(28) (29) و(30) و(31) و(32) و(33) و(34) و(35) و(36) و(37) و(38) و(39) و(40) و(41) من هذا القانون.
د- تضع اللائحة القواعد والشروط والضوابط وغير ذلك من المسائل اللازمة لتطبيق أحكام هذه المادة بما يتسق مع القواعد النموذجية والتوجيهات الإدارية والتعليقات الصادرة عن منظمة التعاون الاقتصادي والتنمية OECD.

What does the Article mean in plain language?
Exclusion does not make an entity invisible: its revenue may count under Article 3 and many procedural and enforcement provisions still apply. Subsidiary exclusions also depend on ownership and activity or income conditions.

Is the Article enough on its own?
Usually not. The Decree-Law states the rule, the Regulations detail the computation or procedure and guidance explains application. Use all three for an obligation, amount or deadline.
