نطاق الضريبة
أ- تُفرَض ضريبة عن السنة المالية على الدخل الخاضع للضريبة، وتكون واجبة الدفع من قبل كيان مشارك مكلف بالإقرار عن كيان مشارك يقع في المملكة، ويكون عضواً في مجموعة المشاريع متعددة الجنسيات بشرط أن يكون مستوفياً لاختبار مستوى الإيرادات المشار إليه في الفقرة (ج) من هذه المادة.
ب- تُفرَض ضريبة عن السنة المالية على الدخل الخاضع للضريبة، وتكون واجبة الدفع من قبل كيان مشارك مكلف بالإقرار عن مشروع مشترك والشركات التابعة لذلك المشروع المشترك والتي تقع في المملكة، إن وجدت، على أن يكون الكيان الأم النهائي للمشروع المشترك أو للشركات التابعة للمشروع المشترك هو الكيان الأم النهائي لمجموعة مشاريع متعددة الجنسيات، بشرط أن يكون مستوفياً لاختبار مستوى الإيرادات المشار إليه في الفقرة (ج) من هذه المادة.
ج- يعتبر اختبار مستوى الإيرادات لسنة مالية مستوفياً إذا كانت الإيرادات السنوية لمجموعة المشاريع متعددة الجنسيات تساوي أو تتجاوز سبعمائة وخمسين مليون يورو في القوائم المالية الموحدة للكيان الأم النهائي "Ultimate Parent Entity" وذلك لسنتين على الأقل من السنوات المالية الأربع السابقة مباشرة للسنة المالية، وفي حال كانت سنة واحدة أو أكثر من السنوات المالية الأربع تزيد أو تقل عن 12 شهرًا، فيجب تعديل حدّ الإيرادات بشكل نسبي لكل سنة من تلك السنوات المالية.
د- على الرغم مما تنص عليه أحكام المادة (4) من هذا القانون، يؤخذ في الاعتبار إيرادات الكيانات المستبعدة وذلك لأغراض تحديد استيفاء اختبار مستوى الإيرادات.
ه- يجب على الكيان المشارك المكلف بالإقرار سداد الضريبة الحالية الإضافية والضريبة الإضافية للفروقات الدائمة التي يتم احتسابهما وفقاً للفقرات (د) و (و) من المادة (9) من هذا القانون، فضلاً عن سداد أي مبلغ مستحق بموجب أحكام الفقرات (أ) و(ب) و(ج) من هذه المادة.

What does the Article mean in plain language?
The threshold tests consolidated group revenue, not the Bahrain entity's sales alone. Revenue of excluded entities still counts for the revenue test even though those entities are excluded from the charge.
