حق الجهاز في طلب المعلومات والبيانات والمستندات

أ- على جميع الأشخاص والجهات العامة والخاصة في المملكة تزويد الجهاز بالمعلومات والبيانات والمستندات التي يطلبها لأغراض تطبيق الضريبة على المستويين المحلي والدولي أو لإجراءات المساءلة، وذلك خلال المدة التي يراها مناسبة.

ب- للجهاز تبادل المعلومات لأغراض الضريبة المنصوص عليها في هذا القانون بين السلطات الضريبية في الدول التي تكون بينها وبين المملكة اتفاقيات أو معاهدات أو ترتيبات ضريبية دولية.

ج- يلتزم الجهاز وموظفيه والقائمين على تنفيذ أحكام هذا القانون بعدم الإفصاح عن المعلومات أو البيانات أو المستندات التي حصلوا أو أطلعوا عليها بحكم وظائفهم أو بسببها، أثناء الخدمة أو بعد انتهائها إلا للغاية التي شرعت من أجل اطلاعهم عليها، أو أن يكون طلب الإفصاح عنها صادراً بموجب أمر قضائي بالمملكة، أو بناء على طلب محكمة أو هيئة ذات اختصاص أو سلطة ضريبية في بلد أجنبي أو ولاية قضائية وفقاً للمعاهدات أو الاتفاقيات التي تكون المملكة طرفاً فيها، أو بناء على موافقة من صاحب البيانات.
