حالات فرض الغرامات الإدارية

أ- مع عدم الإخلال بالمسئولية الجنائية، للجهاز فرض غرامة إدارية على كل من ارتكب أحد الأفعال الآتية:

1- عدم التقدم بالتسجيل لأغراض الضريبة خلال المدة المقررة، أو التقدم بالتسجيل باستخدام بيانات خاطئة على ألا تتجاوز الغرامة المفروضة مائة ألف دينار بحريني.

2- عدم تقديم الإقرار الضريبي أو التأخر في تقديمه عن المدة المقررة، على ألا تتجاوز الغرامة المفروضة (30%) من قيمة الضريبة التي كان يتعين الإقرار بها.

3- عدم سداد الضريبة أو التأخر في سدادها عن المدة المقرَّرة، بنسبة (1%) من قيمة الضريبة المستحقة أو الدفعة المعجلة وذلك عن كل شهر أو جزء من الشهر بشكل نسبي لم تسدد عنه الضريبة من تاريخ استحقاقها ولا تتجاوز الغرامة (70%) من قيمتها.

4- تقديم بيانات خاطئة بالإقرار الضريبي أدت إلى احتساب مبلغ ضريبة أقل مما هو مستحق، على ألا تتجاوز الغرامة المفروضة (30%) من قيمة الضريبة التي كان يتعين الإقرار بها، وتكون الغرامة مبلغاً لا يتجاوز (20%) من قيمة الضريبة التي كان يتعين الإقرار بها في حال التقدم الطوعي للإقرار المعدل والصحيح.

5- تقديم بيانات خاطئة بالإقرار الضريبي والتي لا تؤدي إلى احتساب مبلغ ضريبة أقل مما هو مستحق قانوناً، وتفرض غرامة في هذه الحالة لا تتجاوز ألف دينار بحريني.

ب- مع عدم الإخلال بالمسئولية الجنائية، للجهاز أن يفرض غرامة إدارية لا تتجاوز خمسين ألف دينار بحريني على كل من ارتكب أحد الأفعال الآتية:

1- أعاق أو عطل عمل موظفي الجهاز أو المكلفين عنه أو حجب عن الجهاز أي بيانات أو معلومات أو سجلات أو مستندات من تلك التي يتعين عليه تزويد الجهاز بها أو تمكينه من الاطلاع عليها وذلك للقيام بمهامه المقررة بموجب هذا القانون.

2- عدم إخطار الجهاز بالتغييرات التي طرأت على بيانات طلب التسجيل أو مرفقات الإقرار الضريبي خلال المواعيد المقررة.

3- عدم تقديم البيانات أو المستندات أو السجلات أو الدفاتر المحاسبية أو القوائم المالية أو الفواتير أو المحررات التي طلبها الجهاز أو تأخر في تقديمها.

4- عدم الاحتفاظ بطريقة منتظمة بالسجلات والدفاتر المحاسبية والقوائم المالية والفواتير وكافة المستندات والمحررات.

5- مخالفة أيِّ من أحكام هذا القانون أو اللائحة أو القرارات المنفذة له.

ج- يكون فرض الغرامة الإدارية بقرار يصدره الجهاز، ويجوز له أن ينشر بياناً بالمخالفة التي ثبت وقوعها وذلك بالوسيلة والكيفية التي يحددها، على ألا يتم النشر إلا بعد فوات ميعاد الطعون الضريبية أو صدور حكم بات بثبوت المخالفة، بحسب الأحوال.

What does the Article mean in plain language?

There is no single penalty for every error: failure to register on time or registering with incorrect data up to BHD 100,000; failure or delay in filing up to 30% of the tax that should have been declared; non-payment or late payment 1% of the tax or advance payment per month or part month, pro rata, capped at 70%; incorrect data reducing tax up to 30% (up to 20% on voluntary correction); incorrect data with no tax effect up to BHD 1,000; obstruction, failure to report changes, failure to provide or keep records and other breaches up to BHD 50,000 (Article 28(a)–(b)). Classify the conduct, tax impact, voluntary correction, delay and amount first.

Is the Article enough on its own?

Usually not. The Decree-Law states the rule, the Regulations detail the computation or procedure and guidance explains application. Use all three for an obligation, amount or deadline.
