سداد الضريبة

أ- يجب على الكيان المشارك المكلف بالإقرار سداد دفعات معجلة من الضريبة عن كل فترة مدتها ثلاثة أشهر كاملة أو جزء من فترة الثلاثة أشهر خلال السنة المالية، واستثناء من ذلك في حال كانت السنة المالية تقل عن ثلاثة أشهر فلا يجب سداد أي دفعات معجلة.

ب- لأغراض تحديد الفترات التي تستحق عنها الدفعات المعجلة (فترة الدفعة المعجلة)، تتكون السنة المالية من فترات متتالية مدتها ثلاثة أشهر تبدأ من اليوم الأول من السنة المالية. وإذا كان العدد الإجمالي للأشهر في السنة المالية لا يمكن قسمته لتكون كل فترة دفعة معجلة على ثلاثة أشهر بشكل متساوٍ، فتكون الفترة الأخيرة أقصر من الفترات السابقة ذات الثلاثة أشهر، بحيث تغطي الفترة الأخيرة ما تبقى من السنة المالية.

ج- يجب سداد كل دفعة معجلة في مهلة لا تتجاوز ستين يومًا بعد نهاية كل فترة دفعة معجلة.

د- على الكيان المشارك المكلف بالإقرار القيام باختيار لاحتساب الدفعات المعجلة لسنة مالية باستخدام طريقة الاحتساب على أساس السنة السابقة طبقاً للفقرة (ه) أو باستخدام طريقة الاحتساب على أساس السنة الحالية طبقًا للفقرة (و) من هذه المادة، على أن يقوم الكيان المشارك المكلف بالإقرار بإجراء الاختيار بالطريقة التي يحددها الجهاز، وذلك في موعد استحقاق الدفعة المعجلة الأولى للسنة المالية، ولا يكون هذا الاختيار قابلاً للإلغاء للسنة المالية.

ه- لأغراض تطبيق طريقة الاحتساب على أساس السنة المالية السابقة، تحتسب الدفعة المعجلة بناءً على ناتج المعادلة ((أ ÷ ب) x ج)، على أن تكون:

أ: تقدير معقول للضريبة للسنة المالية السابقة للكيانات المشاركة والمشاريع المشتركة والشركات التابعة لمشروع مشترك لمجموعة مشاريع متعددة الجنسيات التي تقع في المملكة بحسب الأحوال، ولأغراض سنة الانتقال يحتسب التّقدير المعقول للضريبة لتلك الكيانات كما لو كانت قد دخلت في نطاق تطبيق القانون في تلك السنة المالية السابقة.

ب: عدد الأيام في السنة المالية السابقة.

ج: عدد الأيام في فترة الدفعة المعجلة التي تستحق عنها الدفعة المعجلة ذات الصلة.

و- لأغراض تطبيق طريقة الاحتساب على أساس السنة المالية الحالية، تحتسب كل دفعة معجلة بناءً على ناتج المعادلة (أ) - (ب)، على أن تكون:

أ: تقدير معقول للضريبة التي ستكون مستحقة عن فترة تبدأ في اليوم الأول للسنة المالية وتنتهي في اليوم الأخير من فترة الدفعة المعجلة كما لو كانت هذه الفترة سالفة الذكر سنة مالية لأغراض تطبيق أحكام القانون وهذه اللائحة.

ب: مجموع الدفعات المعجلة التي تم سدادها للسنة المالية، إن وجدت.

ز- استثناءً مما نصت عليه الفقرة (ج) من هذه المادة، يُسدد الكيان المشارك المكلف بالإقرار الدفعة المعجلة الأولى عن سنة الانتقال عند نفاذ القانون ضمن فترة استحقاق الدفعة المعجلة الثانية لتلك السنة.

ح- يجب على الكيان المشارك المكلف بالإقرار الاحتفاظ بالمستندات المؤيدة لكيفية احتساب كل دفعة معجلة على حدة وتزويد الجهاز بتلك المستندات عند طلبها.

ط- يجب على الكيان المشارك المكلف بالإقرار سداد أي رصيد متبقٍّ من الضريبة المستحقة عن السنة المالية الواجب الإقرار عنها في مدة لا تتجاوز خمسة عشر شهرًا بعد آخر يوم من السنة المالية الواجب الإقرار عنها.

ي- عند القيام بعملية السداد، يجب على الكيان المشارك المكلف بالإقرار أن يحدد الرقم المرجعي الخاص بالفاتورة الصادرة من الجهاز التي تبين المبالغ المستحقة للجهاز.

What does the Article mean in plain language?

Split the Fiscal Year from its first day into consecutive three-month periods, with a possibly shorter final period. No advances are due where the Fiscal Year itself is shorter than three months. Pay each advance within 60 days after its period. Elect the prior-year or current-year method by the first advance deadline without changing it during the year. Commencement transition has a special first-payment deferral. Pay the final balance within 15 months of year-end and reconcile actual payments to NBR invoice references.

How can the rule appear in practice?

If an advance-payment period ends on 31 March, the 60 days end on 30 May under Article 85. For a calendar-2025 commencement Transition Year, the first advance (January–March) was payable with the second, i.e. by 29 August 2025 (if Friday counts as an official holiday under Art. 85(b), the deadline moves to the next working day).
