تعيين الكيان المشارك المكلف بالإقرار

أ- يتعين على الكیان المشارك المكلف بالإقرار وفقًا للمادة (18) من القانون أو الفقرتين (ب) أو (ج) من هذه المادة، تقديم تصريح موافقة كتابي بالطريقة التي يقبلها الجهاز، على أن يتضمن موافقة جميع الكيانات التي قامت بتعيينه ككيان مشارك مكلف بالإقرار.

ب- إذا توقف الكیان المشارك المكلف بالإقرار عن نشاطه الاقتصادي في المملكة أو خرج من مجموعة المشاريع متعددة الجنسيات كما هو مشار إليه في المادة (38) من هذه اللائحة أو لم يعد يقع في المملكة، يتعين على الكیان المشارك المكلف بالإقرار تعيين أو ترتيب تعيين بديل لكيان مشارك مكلف بالإقرار وذلك بالطريقة التي يحددها الجهاز، وعليه أن يقدم تصريح موافقة كتابي خلال ثلاثين يومًا من تاريخ تحقق أي من هذه الحالات.

ج- استثناءً مما نصت عليه الفقرة (ب) من هذه المادة، يجوز للكیان المشارك المكلف بالإقرار لأي سبب كان، تقديم تصريح موافقة كتابي جديد بالطريقة التي يقبلها الجهاز لتعيين بديل لكيان مشارك أو لمشروع مشترك أو لشركة تابعة لمشروع مشترك يقع في المملكة ويكون جزءًا من ذات مجموعة المشاريع متعددة الجنسيات التي يمثلها وفقًا للمادة (18) من القانون ليتصرف ككيان مشارك مكلف بالإقرار.

د- عندما يتم تعيين بديل لكیان مشارك مكلف بالإقرار وفقًا لأحكام الفقرة (ب) أو الفقرة (ج) من هذه المادة، فإنه يتولى جميع المسؤوليات والالتزامات المفروضة بموجب أحكام القانون وهذه اللائحة على الكیان المشارك المكلف بالإقرار السابق عن السنوات المالية السابقة، بما في ذلك تقديم الإقرارات الضريبية، وسداد الضرائب، والاحتفاظ بالسجلات وذلك اعتبارًا من التاريخ الذي قام الجهاز بإخطار ذلك الكيان بتعيينه بديلاً للكيان المشارك المكلف بالإقرار السابق.
