تخصيص الضرائب المشمولة

أ- تُخصّص للمنشأة الدائمة لكيان مشارك الضرائب المشمولة المدرجة في الحسابات المالية للكيان المشارك والتي تتعلق بدخل أو خسارة الكيان المشارك لتلك المنشأة الدائمة.

ب- تُخصّص لمُلاك الكيان المشارك، الضرائب المشمولة المُدرجة في الحسابات المالية لكيان شفاف ضريبيًا فيما يتعلق بدخل أو خسارة الكيان المشارك المُخصص لمُلّاك الكیان المشارك وفقًا للفقرة (د) من المادة (11) من هذه اللائحة.

ج- تُخصّص للكيان المشارك، الضرائب المشمولة المُدرجة في الحسابات المالية لمالك ذلك الكیان المشارك والتي تتعلق بالضرائب المدفوعة بموجب نظام ضريبة الشركة الأجنبية المسيطر عليها على حصة مالك الكيان المشارك من دخل الكيان المشارك.

د- تُخصّص للكيان الهجين، الضرائب المشمولة المُدرجة في الحسابات المالية لمالك الكيان المشارك والتي تتعلق بدخل أو خسارة الكيان المشارك لذلك الكيان الهجين.

ه- استثناءً من الفقرتين (ج) و (د) من هذه المادة، على الكيان المشارك الذي تم تخصيص ضرائب مشمولة له وفقًا للفقرتين (ج) و(د) فيما يتعلق بدخله السلبي، أن يدرج في ضرائبه المشمولة المعدلة مبلغًا يساوي الأقل من أي مما يلي:

1- الضرائب المشمولة المُخّصصة فيما يتعلق بهذا الدخل السلبي.

2- مبلغ يتم تحديده وفقًا للمعادلة: (أ × ب) على أن يكون:

أ: نسبة الضريبة الإضافية للسنة المالية المحددة دون الأخذ في الاعتبار الضرائب المشمولة المتكبدة فيما يتعلق بهذا الدخل السلبي من قبل مالك الكيان المشارك.

ب: مقدار الدخل السلبي للكيان المشارك المُدرج بموجب نظام ضريبة الشركة الأجنبية المسيطر عليها أو قاعدة الشفافية لأغراض الضريبية.

و- لا تُخصَص أي ضرائب مشمولة يتكبدها مالك الكیان المشارك تتعلق بالدخل السلبي المتبقي وذلك بعد تطبيق الفقرة (ه) من هذه المادة، بموجب الفقرتين (ج) و (د) من هذه المادة.

ز- تُخصص الضرائب المشمولة المستحقة في الحسابات المالية للمُلاك المباشرين للكيان المشارك على التوزيعات من الكيان المشارك التي تمت خلال السنة المالية، إلى الكيان المشارك الذي قام بالتوزيع.

ح- عندما يُعامل دخل الكيان المشارك للمنشأة الدائمة كدخل الكيان المشارك للكيان الرئيسي وفقًا للفقرة (ح) من المادة (10) من هذه اللائحة، تُعامل أي ضرائب مشمولة تنشأ في الولاية القضائية التي تقع فيها المنشأة الدائمة والمتعلقة بهذا الدخل كضرائب مشمولة للكيان الرئيسي وذلك إلى حدّ مبلغ يتم تحديده وفقًا للمعادلة (ج × د) على أن يكون:

ج: مبلغ دخل الكيان المشارك للمنشأة الدائمة الذي يُعامل كدخل الكيان المشارك للكيان الرئيسي وفقًا للفقرة (ح) من المادة (10) من هذه اللائحة.

د: أعلى معدل لضرائب الدخل المفروضة على الدخل الاعتيادي في الولاية القضائية التي يقع فيها الكيان الرئيسي.

What does the Article mean in plain language?

Tax recorded by one entity may relate to a PE or another entity's income. This Article allocates taxes for PEs, transparency, CFC regimes, hybrids and distributions. Passive-income allocation is capped at the lesser of the relevant tax and the specified Additional Tax Rate multiplied by that income. Income attributed back to a Main Entity under Article 10 has another cap. Read these rules with the Covered Tax exclusions and Article 32's prohibition of duplicate adjustments. Tax relating to another entity requires an applicable allocation rule and its conditions.
