استبعاد الضرائب المشمولة المعدلة من احتساب معدل الضريبة الفعلي
لأغراض تطبيق أحكام الفقرة (أ) من المادة (8) من القانون، يجب استبعاد الضرائب المشمولة المعدلة التالية من احتساب معدل الضريبة الفعلي للكيانات المشاركة التي تقع في المملكة:
أ- أي مبلغ من الضرائب المشمولة لمالك الكيان المشارك الخاضع لنظام ضريبة الشركة الأجنبية المسيطر عليها، والذي يمكن تخصيصه بموجب الفقرة (ج) من المادة (29) من هذه اللائحة لكيان مشارك يقع في المملكة.
ب- أي مبلغ من الضرائب المشمولة للكيان الرئيسي يمكن تخصيصه بموجب الفقرة (أ) من المادة (29) من هذه اللائحة للمنشأة الدائمة التي تقع في المملكة، بخلاف الضرائب المشمولة التي تنشأ من ضريبة مفروضة بموجب أي قانون آخر في المملكة.
ج- أي مبلغ من الضرائب المشمولة لمالك الكيان المشارك على دخل كيان هجين ويمكن تخصيصه بموجب الفقرة (د) من المادة (29) من هذه اللائحة لكيان هجين يقع في المملكة.
د- أي مبلغ من الضرائب المشمولة المتكبدة بخصوص الدخل السلبي بموجب الفقرة (ه) من المادة (29) من هذه اللائحة.
ه- أي مبلغ من الضرائب المشمولة لمالك الكيان المشارك التي تفرضها المملكة ويمكن تخصيصه بموجب الفقرة (ز) من المادة (29) من هذه اللائحة لكيان مشارك يقع في المملكة، ما لم تكن هذه الضرائب المشمولة تتعلق بضريبة استقطاع مفروضة بموجب قانون آخر في المملكة.

What does the Article mean in plain language?
This Article removes specified taxes from Bahrain's effective-rate computation even where Article 29 allocates them. Cases include CFC taxes, Main Entity taxes on PE income, owner taxes on hybrid and passive income, and certain distribution taxes, subject to the stated Bahrain exceptions. Apply two tests: whether the tax is allocable and whether it may enter Bahrain's rate. Foreign group taxes are not automatically included in the numerator.
