تخصيص صافي الدخل أو الخسارة المحاسبية للكيان الرئيسي والمنشأة الدائمة
أ- مع مراعاة أحكام الفقرتين (ج) و(د) من هذه المادة، عندما يكون الكيان المشارك منشأة دائمة وفقًا للفقرات (أ) أو (ب) أو (ج) من تعريف المنشأة الدائمة المنصوص عليه في المادة (1) من القانون، يكون صافي الدخل أو الخسارة المحاسبية للمنشأة الدائمة هو صافي الدخل أو الخسارة المدرج في الحسابات المالية المنفصلة لتلك المنشأة الدائمة.
ب- في حال لم يكن للمنشأة الدائمة حسابات مالية منفصلة، فإن صافي الدخل أو الخسارة المحاسبية لها يكون هو المبلغ الذي كان من الممكن إدراجه في حساباتها المالية المنفصلة لو تم إعدادها بشكل مستقل ووفقاً للمعيار المحاسبي المستخدم في إعداد القوائم المالية الموحدة للكيان الأم النهائي لمجموعة المشاريع متعددة الجنسيات.
ج- يجب تعديل صافي الدخل أو الخسارة المحاسبية للمنشأة الدائمة التي تنطبق عليها الفقرتين (أ) و (ب) من تعريف المنشأة الدائمة المنصوص عليه في المادة (1) من القانون، ليُدرج فقط المبالغ والبنود المتعلقة بالدخل والنفقة المنسوبة إلى هذه المنشأة الدائمة وفقاً للاتفاقية الضريبية المعمول بها أو القانون المحلي للولاية القضائية التي تقع فيها، بغض النظر عن مبلغ الدخل الخاضع للضريبة ومبلغ النفقات القابلة للخصم ضريبيًا في تلك الولاية القضائية.
د- يجب تعديل صافي الدخل أو الخسارة المحاسبية للمنشأة الدائمة التي تنطبق عليها الفقرة (ج) من تعريف المنشأة الدائمة المنصوص عليه في المادة (1) من القانون ليتضمن فقط المبالغ والبنود المتعلقة بالدخل والنفقة المنسوبة إلى هذه المنشأة الدائمة وفقًا للمادة (7) من الاتفاقية الضريبية النموذجية.
ه- عندما يكون الكيان المشارك منشأة دائمة وفقًا للفقرة (د) من تعريف المنشأة الدائمة المنصوص عليه في المادة (1) من القانون، يكون صافي الدخل أو الخسارة المحاسبية لتلك المنشأة الدائمة مساوياً للدخل المعفى من الضريبة في الولاية القضائية التي يقع فيها الكيان الرئيسي لكون ذلك الدخل المعفى من الضريبة منسوباً إلى العمليات التي تُجرى في الولاية القضائية الأخرى. يجب احتساب صافي الدخل أو الخسارة المحاسبية للمنشأة الدائمة بناءً على النفقات التي لم تكن مخصومة لأغراض الضريبة في الولاية القضائية التي يقع فيها الكيان الرئيسي والتي تُنسب إلى تلك العمليات.
و- لا يؤخذ في الاعتبار صافي الدخل أو الخسارة المحاسبية للمنشأة الدائمة عند تحديد دخل أو خسارة الكيان المشارك للكيان الرئيسي.
ز- استثناءً مما تنص عليه الفقرة (و) من هذه المادة، عندما تتكبد المنشأة الدائمة خسارة الكيان المشارك، تُعامل هذه الخسارة كنفقة للكيان الرئيسي لأغراض احتساب دخل أو خسارة الكيان المشارك لذلك الكيان الرئيسي وليس كنفقة لتلك المنشأة الدائمة، بالمقدار الذي:
1- تُعامل خسارة المنشأة الدائمة كنفقة عند احتساب الدخل المحلي الخاضع للضريبة لذلك الكيان الرئيسي.
2- لا تُعوَّض الخسارة مقابل بند من الدخل الذي يخضع للضريبة بموجب قوانين كلٍّ من الولاية القضائية للكيان الرئيسي والولاية القضائية للمنشأة الدائمة.
ح- عند تطبيق نص الفقرة (ز) من هذه المادة، يُعامل دخل الكيان المشارك الذي تحققه المنشأة الدائمة لاحقًا كدخل الكيان المشارك للكيان الرئيسي وليس للمنشأة الدائمة لأغراض تحديد دخل أو خسارة الكيان المشارك، وذلك في حدود مبلغ خسارة الكيان المشارك التي اعتُبرت سابقًا كنفقة للكيان الرئيسي.

What does the Article mean in plain language?
First identify the PE category under Law Article 1. For categories A, B and C, start with net income or loss in the PE's separate accounts. If no separate accounts exist, determine what would have appeared in standalone accounts under the Ultimate Parent Entity's consolidation standard. Missing separate accounts do not make the PE's income zero.
For categories A and B, adjust the accounts to include only income and expenses attributable to the PE under the applicable treaty or the law of its jurisdiction, regardless of the amounts taxable or deductible there. For category C, attribution follows Article 7 of the Model Tax Convention. Accordingly, do not automatically substitute taxable profit from a local return for the allocated accounting result.
Category D of the Law's definition has a different rule: determine the result from income exempt in the Main Entity's jurisdiction because it is attributable to operations in the other jurisdiction, taking account of attributable expenses not deducted for tax in the Main Entity's jurisdiction. Do not apply the first three categories' approach without assessing this rule.
Paragraph F generally excludes the PE's accounting net income or loss from the Main Entity's Constituent Entity Income or Loss. Paragraph G instead treats a PE's Constituent Entity Loss as a Main Entity expense to the extent it is an expense in computing the Main Entity's domestic taxable income and is not set off against income taxable in both jurisdictions. Where both conditions apply, the loss is an expense of the Main Entity only, not of the PE.
Paragraph H then attributes the PE's subsequent Constituent Entity Income to the Main Entity rather than the PE, up to the loss previously treated as the Main Entity's expense. Maintain a running schedule of transferred losses, subsequent income and the outstanding balance, rather than simply separating the two accounts permanently. This Article allocates income and loss; assess Covered Tax allocation under its separate provisions.

How can the rule appear in practice?
A PE loss of 100 units fully meets both Paragraph G tests and is treated as an expense of the Main Entity rather than the PE. The PE later earns 60 units and then 70 units: Paragraph H attributes 60 and then 40 to the Main Entity, exhausting the loss balance. The remaining 30 is not transferred under that Paragraph. The example assumes the conditions are established and does not compute final tax.
