نقل السلع الانتقائية بين المستودعات الضريبية

المملوكة لذات المرخص له

أولاً: مع مراعاة أحكام المواد من (24) إلى (29)، يجوز - دون اشتراط الحصول على تصريح من الوزارة - نقل السلع الانتقائية تحت وضع معلق للضريبة بين مستودعين ضريبيين يحوزهما نفس المرخص له، وذلك بمراعاة الآتي:

1- أن يكون لدى المرخص له نظام آلي يمكنه من تتبع النقل بين المستودعات الضريبية المملوكة له بصورة منفصلة.

2- أن يقدم المرخص له للوزارة تقريراً شهرياً على النموذج المعد لهذا الغرض خلال (15) يوماً من انتهاء الشهر الذي تم فيه النقل، يُدرَج فيه جميع عمليات النقل التي حدثت بين مستودعاته الضريبية، ويجب أن يشتمل التقرير على الأقل وعن كل عملية نقل، البيانات الآتية:

أ- بيانات صاحب الترخيص.

ب- أرقام المستودعات الضريبية التي تم الإرسال من خلالها، والتي تم الاستلام فيها، على التوالي.

ج- تاريخ الإرسال من المستودعات المرسلة، وتاريخ الاستلام في المستودعات المستلمة.

د- كميات السلع الانتقائية المرسلة والمستلمة في المستودعات المعنية.

ثانياً: إذا لم يقدم صاحب الترخيص للوزارة التقرير الشهري المشار إليه في الفقرة السابقة، أو في حال وجود اختلاف في الكميات بين السلع الانتقائية المُرسلة وتلك المُستلمة في المستودعات الضريبية المعنية، تقوم الوزارة باتخاذ الإجراءات القانونية اللازمة في هذا الشأن.
