البت في طلب التصريح بنقل السلع الانتقائية

أ- تُصدر الوزارة قرارها بالبت في طلب التصريح بنقل السلع الانتقائية تحت وضع معلق للضريبة خلال (7) أيام من تاريخ تقديمه على النموذج المعد لهذا الغرض.

ب- يُعتبر انقضاء المدة المحددة للبت في الطلب دون رد بمثابة رفضاً ضمنياً للطلب.

ج- يجب على الوزارة رفض طلب التصريح بنقل السلع الانتقائية في الحالتين الآتيتين:

1- إذا كان الطلب غير مستوفٍ لكل أو بعض البيانات أو المعلومات المشار إليها في الفقرة (ثانياً) من المادة (25) من هذه اللائحة.

2- عدم تقديم الموافقة المسبقة للمتلقي صاحب الترخيص حسبما تضمنته الفقرة (ثالثاً) من المادة (25) من هذه اللائحة.

د- تُخطر الوزارة مقدم الطلب بقرارها الصادر بشأن طلبه - بالموافقة أو الرفض - وذلك بالطرق المقررة قانوناً.

ه- إذا صدر قرار الوزارة بالموافقة على طلب التصريح بالنقل، فينبغي أن يشتمل التصريح على رقم خاص مطبوع يُجيز للمرخص له نقل السلع الانتقائية تحت وضع معلق للضريبة.

و- يجوز لمقدم الطلب التظلم لدى الوزارة من قرارها الصادر برفض طلبه خلال (7) أيام من تاريخ إخطاره برفض طلبه، أو خلال (7) أيام التالية لانقضاء المدة المعتبرة رفضاً ضمنياً للطلب، ويجب البت في تظلمه خلال (15) يوماً من تاريخ تقديمه، ويعتبر فوات هذه المدة دون إخطاره بنتيجة التظلم بمثابة رفضاً ضمنياً له.

ز- يسري التصريح بنقل السلع الانتقائية تحت وضع معلق للضريبة لمدة (15) يوماً من تاريخ صدوره.

What does the Article mean in plain language?

The Ministry decides a permit application within 7 days and silence is deemed refusal; a grievance may be filed within only 7 days of notice of refusal or of the deemed refusal and is decided within 15 days. The permit is valid for 15 days from issue (extendable once by a similar period under Article 27(b)). On refusal, examine reasons and notice; on approval, match the consignment to the permit before departure. Issuance does not end the sender's responsibility for receipt and closure under Article 29.
