التزامات ومسئوليات المرخص له

أ- مع مراعاة التزامات ومسئوليات المسجل المحددة بموجب المادة (10) من القانون، والمادة (11) من هذه اللائحة، يجب أن يكون لدى المرخص له نظام إداري لكل مستودع ضريبي مرخص به يمكنه من إدارته على أكمل وجه، ويجب أن يتضمن هذا النظام على الأقل البيانات والمعلومات الآتية:

1- كمية ونوع السلع الانتقائية المطروحة للاستهلاك والفواتير المتعلقة بها، أو مستندات النقل في حال نقل السلع الانتقائية في وضع معلق للضريبة.

2- كمية ونوع السلع الانتقائية المصنعة أو التي تم استخدامها في عملية الإنتاج في المستودع الضريبي.

3- كمية ونوع السلع الانتقائية التي تم استلامها أو نقلها تحت وضع معلق للضريبة الانتقائية من أو إلى مستودع ضريبي.

4- للوزارة أن تطلب ما تراه مناسباً من بيانات أو معلومات أخرى ضمن الشروط والأحكام الواردة بترخيص المستودع الضريبي.

ب- وضع العلامة المميزة على السلع الانتقائية التي تستحق عنها الضريبة طبقاً لنص المادة (44) من هذه اللائحة من خلال المورد المعتمد من الجهاز، خاصةً في الأحوال التي يستخدم فيها المستودع لإنتاج أو تخزين سلع أخرى غير خاضعة للضريبة الانتقائية. [عُدّل بالقرار رقم (31) لسنة 2022]

ج- إجراء الفحوص أو المعاينات التي تطلب الوزارة أو الجهات المعنية من صاحب الترخيص إجراؤها على السلع الانتقائية المخزنة بالمستودع الضريبي.
