إلغاء الترخيص

أولاً: يُلغى الترخيص بناءً على قرار يصدر من الوزير في أي من الحالات الآتية:

1- تقديم طلب من المرخص له بإلغاء الترخيص، وذلك وفقاً للإجراءات والضوابط الآتية:

أ- يُقدم طلب إلغاء الترخيص بالمستودع الضريبي كتابة إلى الوزارة على النموذج المعد لهذا الغرض، على أن يتضمن الطلب على الأقل البيانات الآتية:

1) بيانات المرخص له، تتضمن رقم تسجيله لأغراض الضريبة الانتقائية ورقم ترخيص المستودع الضريبي.

2) أسباب تقديم طلب إلغاء الترخيص.

ب- تقوم الوزارة بالبت في الطلب خلال (15) يوماً من تاريخ تقديمه، ويعتبر انقضاء المدة المحددة للبت فيه دون رد بمثابة رفضاً ضمنياً للطلب، ويجوز لمقدم الطلب التظلم لدى الوزارة من قرارها الصادر برفض إلغاء الترخيص خلال (30) يوماً من تاريخ إخطاره برفض طلبه أو خلال (30) يوماً التالية لانقضاء المدة المعتبرة رفضاً ضمنياً للطلب، ويجب البت في التظلم خلال (15) يوماً من تاريخ تقديمه، ويعتبر انقضاء هذه المدة دون إخطاره بنتيجة التظلم بمثابة رفضاً ضمنياً له.

ج- يشترط للموافقة على طلب إلغاء الترخيص في هذه الحالة، ما يلي:

1) تقديم المرخص له ما يفيد انتهاءه من القيام بكافة التزاماته ومسئولياته خلال مدة الترخيص السابقة على تقديم طلب إلغاء الترخيص.

2) قيام المرخص له بتحديد نوع وكميات وقوائم أسعار السلع الانتقائية الباقية بالمستودع الضريبي في تاريخ تقديم طلب إلغاء الترخيص.

3) قيام المرخص له بتحديد السلع الانتقائية الموجودة في المستودع الضريبي المراد إلغاء ترخيصه تحت وضع معلق للضريبة.

4) الإقرار عن الضريبة المستحقة نتيجة للإفراج عن السلع الانتقائية من المستودع الضريبي، وسدادها بواسطة إقرار ضريبي.

5) إبلاغ الوزارة فور إنهاء إجراءات طلب إلغاء الترخيص.

2- إذا لم يُستخدم ترخيص المستودع الضريبي في الغرض المرخص من أجله لمده تزيد على (90) يوماً.

3- إذا انقضت الشركة صاحبة الترخيص.

ثانياً: إذا قررت الوزارة إلغاء الترخيص، فعليها إبلاغ المرخص له بقرارها وذلك بالطرق المقررة قانوناً، على أن تٌحدد فيه تاريخ سريان إلغاء الترخيص.

ثالثاً: إذا توفي المرخص له ينتقل الترخيص إلى خلفه، وفقاً للشروط والإجراءات الآتية:

1- أن يتم تقديم شهادة وفاة المرخص له إلى الوزارة.

2- أن يكون الترخيص سارياً وقت وفاة صاحب الترخيص.

3- أن يزاول الخلف ذات الأنشطة التي كان يزاولها صاحب الترخيص في المستودع الضريبي.

4- أن يقدم الخلف بياناً بالسلع الانتقائية الموجودة في المستودع الضريبي المراد نقل ترخيصه تحت وضع معلق للضريبة.

ويسرى الترخيص في هذه الحالة لمدة ثلاثة أشهر أو للمدة المتبقية منه أيهما أقل، فإذا رغب الخلف في الاستمرار في نشاط صاحب الترخيص لمدة أطول من المدة المشار اليها، وجب عليه تقديم طلب لنقل الترخيص باسمه إلى الوزارة على النموذج المعد لهذا الغرض خلال المدة المذكورة، فإذا انقضت هذه المدة دون تقديم هذا الطلب اعتبر الترخيص لاغياً.

The licence is cancelled after more than 90 days of non-use or on company dissolution, and a cancellation request is decided within 15 days. On death the licence passes to the successor subject to conditions (death certificate, valid licence, same activity, statement of suspended goods) for three months or the remaining term, whichever is shorter; to continue, the successor must apply for transfer within that period or the licence lapses. The Article provides no transfer of the licence on a sale of the business, so a buyer needs a new licence (Madar inference).
