الضمان المالي

أ- على المرخص له أو طالب الترخيص – بحسب الأحوال - أن يقدم ضماناً مالياً يعادل قيمة الضريبة المستحقة طبقاً لحالات فرض الضريبة الخاصة بهذا المستودع الضريبي.

ب- يسري على الضمان المالي المقدم عن المستودعات الضريبية داخل الدائرة الجمركية ذات الشروط والأوضاع والإجراءات المقررة بشأن الضمان المالي المتعلق بالضريبة “الرسوم” الجمركية.

ج- تحتسب الضريبة المستحقة فيما يتعلق بالمستودعات الضريبية خارج نطاق الدائرة الجمركية، على أساس مجموع الكميات التقديرية التالية وما يقابلها من أسعار بيع التجزئة:

1- كمية السلع الانتقائية التي يتم حيازتها في المستودع الضريبي.

2- كمية السلع الانتقائية المطروحة للاستهلاك خلال مدة شهر.

3- كمية السلع الانتقائية التي وضعت تحت وضع معلق للضريبة الانتقائية خلال مدة شهر.

د- يجوز للوزارة خفض قيمة الضمان المالي، بشرط ألا يقل في جميع الأحوال عن نسبة (5%) من القيمة المحتسبة وفقاً للفقرة (أ) من هذه المادة.

ه- يجوز للوزارة زيادة قيمة الضمان المالي حسب تقديرها متى كان لديها أسباب معقولة بأن الضمان المالي الذي احتسبه المرخص له أو طالب الترخيص – بحسب الأحوال - غير صحيح.

و- يتم إعادة احتساب الضمان المالي كل (12) شهراً لكل مستودع ضريبي.

ز- في حال تعدد المستودعات الضريبية المراد ترخيصها، يُقدم عن كل مستودع ضريبي ضمان مالي مستقل.

What does the Article mean in plain language?

The guarantee equals the tax due; for warehouses outside the customs area it is calculated on stock held plus one month of releases and one month placed under suspension at retail prices. The Ministry may reduce it to no less than 5% or increase it on reasonable grounds; it is recalculated every 12 months and is separate for each warehouse.
