اختيار الشفافية الضريبية للكيانات الاستثمارية وكيانات الاستثمار في مجال التأمين

أ- يجوز للكيان المشارك المكلف بالإقرار لمجموعة المشاريع متعددة الجنسيات إجراء اختيار ليُعامل كيان الاستثمار أو كيان الاستثمار في مجال التأمين ككيان شفاف ضريبي إذا تم استيفاء جميع الشروط الآتية:

1- إذا كان مالك الكیان المشارك لكيان الاستثمار أو لكيان الاستثمار في مجال التأمين يخضع للضريبة في الولاية القضائية التي يقع فيها وفقًا لنظام تحديد القيمة بموجب مؤشر السوق (mark-to-market) أو نظام مشابه يعتمد على التغيرات السنوية في القيمة السوقية العادلة لحصة ملكيته في ذلك الكيان.

2- أن يكون معدل الضريبة المطبق على مالك الكيان المشارك لكيان الاستثمار أو لكيان الاستثمار في مجال التأمين على التغيرات السنوية في القيمة السوقية العادلة المشار إليها في البند (1) من هذه الفقرة مساوياً أو يتجاوز نسبة الحد الأدنى.

ب- أن الكيان المشارك الذي يمتلك حصة ملكية في كيان استثمار أو كيان استثمار في مجال التأمين بشكل غير مباشر من خلال حصة ملكية مباشرة في كيان استثمار أو كيان استثمار في مجال التأمين آخر، يعتبر خاضعًا للضريبة بموجب نظام تحديد القيمة وفقًا لمؤشر السوق (mark-to-market) أو نظام مشابه فيما يتعلق بحصة الملكية غير المباشرة إذا كان خاضعًا لنظام تحديد القيمة وفقًا لمؤشر السوق (mark-to-market) أو نظام مشابه فيما يتعلق بحصة الملكية المباشرة.

ج- في حال إجراء الاختيار المشار له في الفقرة (أ) من هذه المادة، يخصص بشكل نسبي دخل أو خسارة الكيان المشارك والدخل المستبعد على أساس جوهر النشاط لكيان الاستثمار ولكيان الاستثمار في مجال التأمين لمالك الكيان المشارك ذو الصلة بما يتناسب مع حصته من دخل الكيان المشارك في كيان الاستثمار أو كيان الاستثمار في مجال التأمين.

د- في حال إلغاء الاختيار المشار إليه في الفقرة (أ) من هذه المادة، يجب تحديد أي ربح أو خسارة من التصرف في الأصول أو المطلوبات التي يحتفظ بها كيان الاستثمار وكيان الاستثمار في مجال التأمين بناءً على القيمة السوقية العادلة للأصول أو المطلوبات في اليوم الأول من السنة المالية التي يتم فيها الإلغاء.

ه- يٌقصد بالاختيار المشار إليه في نص الفقرة (أ) من هذه المادة ذلك الاختيار المطبق لمدة خمس سنوات والجائز إجراؤه وفقًا للمادة (20) من القانون.

What does the Article mean in plain language?

The transparency election requires the owner to be taxed on annual fair-value changes in the interest at no less than the Minimum Rate, with a rule for indirect ownership. Allocate income or loss and substance exclusion proportionately to the owner. The election lasts five years; on revocation, subsequent disposal results use opening revocation-year fair-market-value bases. Tax on distributions alone is not the mark-to-market condition required here.
