الملاذ الآمن بطريقة الاحتساب المبسط

أ- تعتبر الضريبة بحكم المساوية للصفر عن السنة المالية للكيانات المشاركة التي تقع في المملكة إذا توافرت أي من الحالات الآتية:

1- أن يكون دخل الكيان المشارك، الناتج بطريقة الاحتساب المبسط، يساوي أو يقل عن الدخل المستبعد على أساس جوهر النشاط لتلك السنة المالية.

2- أن يكون متوسط الإيرادات السنوية لجميع الكيانات المشاركة التي تقع في المملكة للسنة المالية وللسنتين الماليتين السابقتين، الناتج بطريقة الاحتساب المبسط، أقل من عشرة ملايين يورو، وأن يكون متوسط دخل الكيان المشارك للسنة المالية الحالية وللسنتين الماليتين السابقتين لجميع الكيانات المشاركة أقل من مليون يورو أو كان لديهم صافي خسارة الكيان المشارك.

3- ألا يقل معدّل الضريبة الفعلي عن نسبة الحد الأدنى لجميع الكيانات المشاركة التي تقع في المملكة.

ب- تضع اللائحة القواعد والشروط والضوابط اللازمة لتطبيق أحكام هذه المادة بما في ذلك طريقة الاحتساب المبسط وغير ذلك من المسائل بما يتسق مع القواعد النموذجية والتوجيهات الإدارية والتعليقات الصادرة عن منظمة التعاون الاقتصادي والتنمية OECD.

What does the Article mean in plain language?

The Regulations do not prescribe the simplified computation: Reg. Art. 56 leaves its rules and conditions to a Ministerial decision approved by Cabinet. Do not rely on this safe harbour until that decision is confirmed as issued and in force.
