فترات حفظ السجلات

أ- طبقًا لأحكام المادة (25) من القانون والمادة (74) من هذه اللائحة، يجب مسك وحفظ السجلات لمدة خمس سنوات بعد نهاية السنة المالية التي تتعلق بها.

ب- يجب مسك وحفظ السجلات المحددة في المادة (25) من القانون والمادة (74) من هذه اللائحة لمدة خمس سنوات بعد نهاية السنة المالية التي تتعلق بها، وذلك من قبل الكيانات المستبعدة التالية:

1- صناديق التقاعد.

2- صندوق الاستثمار الذي يكون كيان أم نهائي.

3- أداة استثمار عقاري التي تكون كيان أم نهائي.

4- باستثناء كيان الخدمات التقاعدية، أي كيان مملوك بنسبة لا تقل عن (95%) من قيمته من قبل واحد أو أكثر من الكيانات المستبعدة المنصوص عليها في البنود (1) و(2) و(3) من هذه الفقرة، سواءً بشكل مباشر أو غير مباشر وذلك بشرط أن يعمل الكيان بشكل حصري أو شبه حصري على تملك الأصول أو استثمار الأموال لصالح الكيانات المستبعدة، وأن يشارك فقط في الأنشطة المساندة لتلك التي تقوم بها الكيانات المستبعدة.

5- باستثناء كيان الخدمات التقاعدية، أي كيان مملوك بنسبة لا تقل عن (85%) من قيمته من قبل واحد أو أكثر من الكيانات المستبعدة المنصوص عليها في البنود (1) و(2) و(3) من هذه الفقرة، سواءً بشكل مباشر أو غير مباشر، وذلك بشرط أن معظم دخل الكيان ناتج بشكل أساسي من أرباح أو خسائر الأسهم أو حقوق الملكية المستثناة من احتساب دخل أو خسارة الكيان المشارك.

ج- استثناءً لما نصت عليه الفقرتين (أ) و (ب) من هذه المادة، يجب الاحتفاظ بالسجلات المتعلقة بالعقارات والأصول الرأسمالية لمدة عشر سنوات بعد نهاية السنة المالية التي تتعلق بها.

د- يجوز للجهاز، قبل انتهاء فترات الاحتفاظ المحددة في الفقرات السابقة، إخطار الكيان بالاحتفاظ بالسجلات لفترة إضافية عن فترة الاحتفاظ السابقة بشرط ألا تتجاوز هذه الفترة الإضافية خمس سنوات.

The ordinary retention period is five years after the relevant Fiscal Year's end, including specified excluded entities. Real-estate and capital-asset records require ten years. Before expiry NBR may notify an extension of up to five additional years. Count from the relevant year-end, not upload or deregistration. Do not destroy records after the general period if a longer category or notified extension applies.
