إلغاء التسجيل

أولاً: يُلغى التسجيل بناءً على قرار يصدر من الوزير في أي من الحالتين الآتيتين:

1- تقديم طلب كتابي من المسجل بإلغاء التسجيل، وذلك وفقاً للإجراءات والضوابط الآتية:

أ- يُقدم طلب إلغاء التسجيل لأغراض الضريبة الانتقائية كتابة إلى الوزارة على النموذج المعد لهذا الغرض، على أن يتضمن الطلب على الأقل البيانات الآتية:

1) بيانات المسجل، بما في ذلك رقم التسجيل.

2) تراخيص المستودعات الضريبية للشخص المسجل لأغراض الضريبة الانتقائية.

3) أسباب تقديم طلب إلغاء التسجيل.

ب- تقوم الوزارة بالبت في الطلب خلال (15) يوماً من تاريخ تقديمه، ويعتبر انقضاء المدة المحددة للبت فيه دون رد بمثابة رفضاً ضمنياً للطلب، ويجوز لمقدم الطلب التظلم لدى الوزارة من قرارها الصادر برفض إلغاء التسجيل خلال (30) يوماً من تاريخ إخطاره برفض طلبه أو خلال (30) يوماً التالية لانقضاء المدة المعتبرة رفضاً ضمنياً للطلب، ويجب البت في التظلم خلال (15) يوماً من تاريخ تقديمه، ويعتبر انقضاء هذه المدة دون إخطاره بنتيجة التظلم بمثابة رفضاً ضمنياً له.

ج- يشترط للموافقة على طلب إلغاء التسجيل، ما يلي:

1) قيام المسجل بسداد جميع الضرائب المستحقة وفقاً لأحكام القانون أو أي قانون ضريبي آخر.

2) سداد جميع الغرامات الإدارية المستحقة وفقاً لأحكام القانون أو أي قانون ضريبي آخر.

3) تقديم جميع الإقرارات الضريبية التي حل موعد تقديمها وفقاً لأحكام القانون أو أي قانون ضريبي آخر.

4) قيام المسجل بإلغاء كل ترخيص لأي مستودع ضريبي يملكه.

2- إذا لم يزاول المسجل النشاط محل التسجيل لمدة سنة من تاريخ التسجيل.

ثانياً: إذا قررت الوزارة إلغاء التسجيل، فعليها إبلاغ المسجل بقرارها وذلك بالطرق المقررة قانوناً، على أن تحدد فيه تاريخ سريان إلغاء التسجيل.
