البت في طلب التسجيل

أ- تُصدر الوزارة قرارها بالبت في طلب التسجيل لأغراض الضريبة الانتقائية خلال (30) يوماً من تاريخ تقديمه على النموذج المعد لذلك.

ب- يُعتبر انقضاء المدة المحددة للبت في طلب التسجيل دون رد بمثابة رفضاً ضمنياً للطلب.

ج- يجب على الوزارة رفض طلب التسجيل في الحالتين الآتيتين:

1- إذا تبين لها انتفاء قصد مقدم الطلب في مزاولة أي نشاط من الأنشطة المشار إليها في المادة (8) من هذه اللائحة.

2- إذا كان الطلب غير مستوفٍ لكل أو بعض البيانات أو المعلومات المشار إليها في المادة (9) من هذه اللائحة.

د- إذا رفضت الوزارة طلب التسجيل تعين عليها تسبيب قرارها الصادر بالرفض.

ه- تُخطر الوزارة مقدم الطلب بقرارها الصادر بشأن طلبه - بالموافقة أو الرفض - وذلك بالطرق المقررة قانوناً.

و- إذا صدر قرار الوزارة بالموافقة على طلب التسجيل، فينبغي أن يشتمل الإخطار على رقم التسجيل.

ز- يجوز لمقدم الطلب التظلم لدى الوزارة من قرارها الصادر برفض تسجيله خلال (30) يوماً من تاريخ إخطاره برفض طلبه، أو خلال (30) يوماً التالية لانقضاء المدة المعتبرة رفضاً ضمنياً للطلب، ويجب البت في تظلمه خلال (15) يوماً من تاريخ تقديمه، ويعتبر انقضاء هذه المدة دون إخطاره بنتيجة التظلم بمثابة رفضاً ضمنياً له.

ح- يعد التسجيل نافذاً من تاريخ صدور القرار بالموافقة على الطلب مشمولاً برقم التسجيل.
