الأحكام الانتقالية

أ- يجب على الكيان المشارك المكلف بالإقرار أن يأخذ في الاعتبار الأصول الضريبية المؤجلة والمطلوبات الضريبية المؤجلة التي تمّ الإفصاح عنها في القوائم المالية للكيانات المشاركة لمجموعات مشاريع متعددة الجنسيات، والمشاريع المشتركة والشركات التابعة لمشروع مشترك، ذات الصلة وذلك لتحديد معدّل الضريبة الفعلي في سنة الانتقال وأي سنة لاحقة.

ب- يجب استبعاد الأصول الضريبية المؤجلة التي نشأت عن البنود المستبعدة من حساب الدخل أو الخسارة للكيان المشارك حسب المادة (6) من هذا القانون، من تطبيق أحكام الفقرة (أ) من هذه المادة عندما تتعلق هذه الأصول الضريبية المؤجلة بالمعاملات التي جرت بعد 30 نوفمبر 2021.

ج- تكون حصة المستحوذ، لأغراض تطبيق هذا القانون، من قيمة الأصل المُستَحوذ عليه معادلة للقيمة الظاهرة للأصل المنقول كما في حسابات الكيان الناقل في التاريخ الذي يسبق مباشرةً عملية التخلص، ويتم احتساب الأصول والمطلوبات الضريبية المؤجلة وفقاً لتلك القيمة وذلك فيما يتعلق بنقل الأصول (فيما عدا المخزون) بين الكيانات المشاركة لمجموعة مشاريع متعددة الجنسيات، المشاريع المشتركة والشركات التابعة لمشروع مشترك بعد 30 نوفمبر 2021 وقبل بداية سنة الانتقال.

د- تضع اللائحة القواعد والشروط والضوابط اللازمة لتطبيق أحكام هذه المادة، بما في ذلك قواعد تحديد معاملة الأصول والمطلوبات الضريبية المؤجلة وغيرها، بما يتسق مع القواعد النموذجية والتوجيهات الإدارية والتعليقات الصادرة عن منظمة التعاون الاقتصادي والتنمية OECD.
