يجوز لمن صدر ضده قرار بفرْض غرامة إدارية التظلُّم منه لدى الوزير خلال ثلاثين يوماً من تاريخ إخطاره به.

ويجب على الوزير البتُّ في التظلُّم خلال خمسة عشر يوماً من تاريخ تقديمه. وتخطِر الوزارة المتظلِّم بالقرار الصادر بشأن تظلُّمه بكتاب مسجل بعلم الوصول. ويعتبر انقضاء هذه المدة دون الإخطار بنتيجة التظلُّم بمثابة رفْض له.

ويجوز الطعن على قرار الوزير برفض التظلُّم أمام المحكمة المختصة خلال ثلاثين يوماً من تاريخ إخطاره برفض التظلُّم أو من تاريخ اعتبار التظلُّم مرفوضاً.
