الغرامات الإدارية

أولاً: فيما عدا حالات التهرب الضريبي المنصوص عليها في المادة (26) من القانون، تفرض غرامة إدارية عند:

1- امتناع المسجل عن تقديم الإقرار الضريبي، بالنسبة للمكلفين بتقديمه عن الفترة الضريبية وذلك بنسبة لا تقل عن (5%) ولا تزيد على (25%) من قيمة الضريبة التي كان يتعين الإقرار بها، ويتعين عند تقدير مبلغ الغرامة بين الحدين المشار إليهما مراعاة الضوابط الآتية:

أ- جسامة المخالفة.

ب- مدى تعمد المخالف ارتكاب المخالفة.

ج- المنافع التي جناها المخالف من وراء ارتكاب المخالفة.

د- مقدار الضرر الذي أصاب الوزارة جراء المخالفة.

2- الامتناع عن سداد الضريبة المستحقة خلال المدة المحددة، وذلك بنسبة تعادل (5%) من قيمة الضريبة غير المسددة عن كل شهر أو جزء منه لم تُسدد عنه الضريبة.

ثانياً: مع عدم الإخلال بأية جريمة ينص عليها أي قانون آخر، تفرض غرامة إدارية لا تزيد على خمسة آلاف دينار - وبمراعاة الضوابط المشار إليها في البند (1) من الفقرة (أولاً) من هذه المادة - على كُل من:

1- منع أو أعاق موظفي الوزارة من أداء واجباتهم الوظيفية.

2- امتنع عن تقديم البيانات أو المعلومات أو المستندات التي تطلبها الوزارة.

3- خالف أي حكم آخر من أحكام القانون أو اللائحة.

ثالثاً: لا يترتب على توقيع الغرامة الإدارية إعفاء المخالف من سداد قيمة الضريبة المستحقة طبقاً لأحكام القانون.

رابعاً: يعد القرار الصادر بفرض الغرامة الإدارية من السندات التنفيذية القابلة للتنفيذ الجبري وفقاً لقانون المرافعات المدنية والتجارية الصادر بالمرسوم بقانون رقم (12) لسنة 1971.
